Mark is a leader specialising in valuation, rating, compulsory purchase and dispute resolution as an arbitrator, independent expert, and expert witness. He has extensive experience in the minerals, waste management, rail and port property sectors. He is also a skilled expert witness and have presented successful evidence at Lands Tribunal.
Mark has experience in valuing numerous quarries, mineral reserves and waste management facilities in the UK, Europe and America. He has also provided advice to multinational companies and SME’s to minimise their business rates liabilities.
Recent projects
- Arbitration – appointed by the Royal Institution of Chartered Surveyors (RICS) to resolve a dispute regarding the correct interpretation of certain lease terms and accounts information. Held a week’s oral hearing before making an award regarding the circa £10M rent review dispute.
- Compulsory Purchase – negotiated compensation for a railhead and related facilities that were compulsorily acquired. Agreed a deferred acquisition date and enhanced business interruption payments including the cost of temporary plant and a new permanent replacement facility.
- Lands Tribunal – presented successful expert witness evidence regarding the appropriate level of compensation due for minerals sterilised by powerlines.
- Single Joint Expert – determined the value of port-related facilities and river access rights.
- County Court – presented successful expert witness evidence regarding various prosecutions.
- Negotiation – Mark’s experience of judicial proceedings and the favourable presentation of evidence enabled him to settle a multimillion-pound compensation claim regarding development land sterilised by powerlines.
- Legal Advice – worked with valuer colleagues to provide a complete and cost-effective expert witness and arbitration management service.
